periwinkle.ae is an international, online marketplace for books, Stationery, uniform and resources related to school education. The Website is operated by Periwinkle International School Supplies LLC.
These terms set out the basis upon which you can access periwinkle.ae, and use the Website to browse and order goods and services.
If you have any questions about periwinkle.ae, or the purchase process (including ordering, payments, exchanges or returns, delivery, etc.), then - in most cases - you will be able to find the answer in these Terms. TERMS
Periwinkle.ae enables users to browse and order the products and services offered on the Website. By accessing periwinkle.ae, ordering any product or service, or otherwise using the Website, you agree to be bound by these Terms. If you do not agree with any of the Terms, your sole recourse is to stop using the Website.
From time to time, changes in law or changes in our business may lead us to make changes to these Terms. Such changes will become effective from the date on which they are made available on the Website. We will try to alert you to such changes (eg.by email), but we also encourage you to review the Terms from time to time to make sure that you remain familiar with them.
All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the site. If you are a minor, you must have parent or guardian read and agree to these Terms of use prior to you using the site.
SERVICES OFFERED
Periwinkle.ae provides a number of Internet-based services through the Web Site (all such services, collectively known as the "Service"). One such service enables users to purchase original merchandise such as stationery, uniforms, shoes, bags, books from various brands. (collectively known as "Products"). Upon placing an order, periwinkle.ae shall ship the product to you and be entitled to its payment for the Services.
PRICING
All prices are subject to change without notice. From time to time, there may be errors in the pricing that appears on the Website or during the order process. We will try to resolve, in good faith, any issues that may arise as a result of such errors. You need to cooperate with us to resolve such issues, and you agree that we shall have full discretion to determine the appropriate resolution in such cases. If we have made a mistake, and the correct price is lower than the stated price, we will charge the lower amount. If the correct price is higher than the price displayed on the Website, we may check with you to see if you want to continue with the order at the higher price or cancel your order.
ORDERING AND PAYMENT
If you use periwinkle.ae to order products and services, you agree to pay the full amount payable for such products and services as indicated during the order process. If the issuer of your credit or debit card refuses to authorize payment, we will cancel your order and contact you for an alternative method of payment. We cannot be held responsible if this results in a delay in dispatching your order.
SHIPPING
Any shipment, delivery or collection dates provided by Periwinkle International are estimates only and shall not form part of the Contract. If Buyer's Order has not been delivered within a reasonable time, due to uncontrollable circumstances like bad weather or natural calamities the Buyer should contact Periwinkle International at : online@periwinkle.ae
PAYMENT & DELIVERY
Books which are not available at the time of delivery, because of reasons such as delay of delivery from the publisher, delay in shipping, will be delivered later and the same will be mentioned in the tax invoice as “will be delivered later “.
Ministry of Education Books (MOE) which is usually released in three parts, in three different terms is mentioned in the Tax invoice as “will be delivered later” .
All the items mentioned " will be delivered later" need to be collected from our retail stores at the customers expense in case the student has opted for distance learning. In case of student opting face to face learning, we will deliver the books to the student in class.
RETURNS AND EXCHANGES
An order maybe exchanged, replaced within 7 days of receiving your order and in accordance with the guidelines set out in these Terms.
• Items should be new, unused, in original packaging, and with all labels and tags still attached.
• The following items cannot be exchanged: Textbooks, guides, CD or DVD and other online resources.
• All items returned in accordance with these criteria will be refunded to the original purchaser's credit card or as store credit
• CHANGE OF WEBSITE AND CESSATION OF OPERATIONS
Periwinkle International reserves the right to change or correct any errors or omissions in the Website, and to alter, limit or discontinue the provision of any of the services provided via the Website, at any time without prior notice to you. Periwinkle International will use reasonable efforts to include up-to-date and accurate information in the Website, but it reserves the right to delete, modify, or supplement the content of periwinkle.ae at any time for any reason without prior notification.
INDEMNITY
You agree to hold harmless and indemnify Periwinkle, its parents, subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, from and against any claims, liabilities, suits, judgments, litigation costs, causes of action, demands, recoveries, losses, damages (actual and consequential), fines, penalties, and attorneys’ fees or other costs or expenses of any kind or nature arising from or in any way related to your use of the Website, including, but not limited to those brought by you or on your behalf in excess of the liability described above, or by third parties as a result of your breach of these Terms, your violation of any law or the rights of a third party, or your use of periwinkle.ae.
TERMINATION
Periwinkle may terminate or suspend your access to all or part of periwinkle.ae, without prior notice, if it believes that your conduct is in violation of these Terms, applicable law, or otherwise harmful to the interests of Periwinkle International’s or any third party. Notwithstanding such termination or suspension, you agree that you will continue to be subject to the obligations which, by their nature, survive such termination or suspension, including the obligations relating to intellectual property rights, User Generated Content, etc.
GOVERNING LAW AND JURISDICTION
The Terms shall be governed by the laws of United Arab Emirates. Any dispute regarding these Terms shall be subject to the exclusive jurisdiction of the Courts in Dubai. If any portion of the Terms is held to be unenforceable, invalid or illegal by any court of competent jurisdiction, the remainder of the Terms shall not be affected.
